1. Acceptance of Terms

By accessing our website, using our services, booking our venue, booking accommodations through third-party platforms, or engaging our pet services, you ("User," "Guest," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services.

2. Services Offered

Venue Rental Services

We provide venue rental services for events including but not limited to weddings, corporate events, parties, and private gatherings at our facilities located in Maine.

Short-Term Accommodation Rentals

We offer short-term accommodation rentals through third-party platforms including Airbnb, Hipcamp, and directly through our website. These accommodations may include cabins, camping sites, glamping options, or other lodging facilities.

Pet Services

We offer pet care services including but not limited to private dog park, pet sitting, dog walking, dog training, group dog classes, doggy daycare, pet boarding, grooming, and related animal care services.

3. Website Use and Online Bookings

Website Terms

  • You must be at least 18 years old to use our website and book services

  • You agree to provide accurate and complete information when making bookings

  • You are responsible for maintaining the confidentiality of your account information

  • You may not use our website for any unlawful purpose or in violation of these Terms

Online Booking System

  • All online bookings are subject to availability and confirmation

  • Booking confirmations will be sent via email

  • You are responsible for reviewing all booking details for accuracy

  • Third-party platform bookings (Airbnb, Hipcamp) are also subject to those platforms' terms of service

4. Reservations and Booking Policies

Venue Rentals

  • All venue bookings require a signed contract and deposit of 50%

  • Deposits are non-refundable unless otherwise specified in writing

  • Final payment is due 14  days prior to the event date

  • Availability is confirmed only upon receipt of signed contract and deposit

Short-Term Accommodations

  • Check-in time: 2pm - 8pm | Check-out time: 11am

  • Maximum occupancy limits must be strictly observed

  • Smoking is prohibited in all indoor accommodations

  • Parties and events require prior approval and may incur additional fees

  • Quiet hours are enforced from 9pm to 8am

  • Pets may be allowed with prior approval and additional pet fee

  • Indoor accommodations pet policy allows for a maximum of 2 dogs per booking. Other pets are not allowed without explicit prior permission.

  • Pets must be with guests at all time, they may not be left alone in indoor accommodations 

Pet Services

  • Services must be booked in advance through our website, app or by phone

  • Emergency services may be available at additional cost

  • Payment is due at time of scheduling unless prior arrangements are made

5. Cancellation and Refund Policy

Venue Rentals

  • Cancellations made more than 30 days before the event: 100% refund of payments made

  • Cancellations made less than 30 days but more than 7 days before the event: 50% refund of payments made

  • Cancellations made 7 days or less before the event: No refund

  • Weather-related cancellations will be handled on a case-by-case basis

  • For large events we recommend renting a tent or other shelter for your guests

Short-Term Accommodations

  • Cancellation policies vary by booking platform and accommodation type

  • Airbnb bookings follow Airbnb's cancellation policy as selected by the host

  • Hipcamp bookings follow Hipcamp's standard cancellation policy

  • Direct bookings: Cancellations made more than 14 days in advance receive full refund minus processing fees

  • No-shows forfeit entire payment

Pet Services

  • Cancellation policies vary by booking platform

  • SniffSpot bookings follow SniffSpot's cancellation policy of 2 hours

  • Direct bookings for training classes, dog walking, and other services: Cancellations made more than 24 hours in advance: Full refund

  • Cancellations made less than 24 hours in advance: 50% charge

  • No-shows: Full charge applies

6. Guest and User Responsibilities

General Responsibilities

  • You must be at least 18 years old to book services

  • You are responsible for the accuracy of all information provided

  • You must comply with all applicable laws and regulations

  • You agree to treat our property, staff, and other guests with respect

Venue Rentals

  • You are responsible for the conduct of all guests and attendees

  • Any damage to the venue or property will be charged to you

  • You must comply with all applicable laws, including liquor licensing requirements

  • You must provide accurate guest counts and event details

  • You are responsible for obtaining any required permits or licenses

  • You are responsible for the conduct of all members of your party

  • You must follow parking rules and requirements set by the property. If you will have more than 10 vehicles, you must organize off-site parking and shuttles to the property

Short-Term Accommodations

  • You are responsible for the conduct of all members of your party

  • Maximum occupancy limits must be strictly observed

  • You must report any damages or issues immediately

  • You are responsible for leaving the accommodation in good condition

  • Smoking, illegal activities, and unauthorized parties are prohibited

  • You must comply with local noise ordinances and quiet hours

  • Checkout procedures must be followed as specified

Pet Services

  • You must provide accurate information about your pet's health, behavior, and needs

  • Pets MUST be current on all required vaccinations or have a documented titer

  • Pets must be in good health. Any pet showing signs of communicable disease or parasites, including but not limited to: diarrhea, coughing, expressing mucus, vomiting, lethargy, or fever must not step foot on the property.

  • You must disclose any aggressive behavior or special medical needs

  • You are responsible for providing necessary supplies unless otherwise arranged

7. Third-Party Platform Integration

Airbnb and Hipcamp Bookings

  • Bookings made through third-party platforms are subject to both our Terms of Service and the respective platform's terms

  • Payment processing is handled by the third-party platform

  • Reviews and ratings on third-party platforms are governed by those platforms' policies

  • Communication regarding bookings may occur through the platform's messaging system

  • Platform-specific cancellation and refund policies take precedence over our direct booking policies

  • We reserve the right to cancel bookings that violate our Terms of Service, even if booked through third-party platforms

Platform Fees and Charges

  • Third-party platforms may charge additional fees beyond our listed rates

  • We are not responsible for platform fees, payment processing fees, or currency conversion charges

  • All taxes and fees will be clearly disclosed during the booking process

8. Liability and Insurance

General Liability

  • Our liability is limited to the amount paid for services

  • We are not responsible for personal property loss or damage

  • Users are encouraged to obtain appropriate travel and personal property insurance coverage

  • We maintain appropriate business insurance but are not liable beyond policy limits

Venue Rentals

  • You assume responsibility for all activities during the rental period

  • You agree to indemnify and hold harmless Wilde Kind, LLC from any claims arising from the event

Short-Term Accommodations

  • You assume responsibility for your safety and the safety of your party during your stay

  • We are not liable for injuries resulting from your use of recreational facilities or outdoor activities

  • You are responsible for securing your personal belongings

  • Travel insurance is recommended for all bookings

Pet Services

  • While we exercise reasonable care, we are not liable for injury, illness, or death of pets except in cases of gross negligence

  • We are not liable for injuries to persons caused by pets during classes, events, training sessions, or other activities on our premises; all participants assume the risk of injury from animal interactions and agree to hold us harmless from any claims arising from pet-related incidents

  • We are not responsible for pre-existing medical conditions

  • Emergency veterinary care will be provided at your expense

9. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, utility failures, or other acts of God. In such cases, we will work with you to reschedule or provide appropriate remedies as circumstances permit.

10. Payment Terms and Pricing

  • Payment methods accepted: Cash, Venmo, or Credit Card (via our website). We do not accept personal checks.

  • Prices listed on our website are subject to change without notice

  • Additional fees may apply for extra services, damages, or excessive cleaning

  • Late payment fees may apply to overdue accounts for direct bookings

  • All prices are subject to applicable taxes

  • Third-party platform payments are processed according to their payment terms

11. Privacy and Data Protection

We collect and use personal information in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We do not sell or share personal information with third parties except as necessary to provide services, comply with third-party platform requirements, or as required by law. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

We maintain outdoor security cameras on our property for safety and security purposes; by using our facilities, you consent to being recorded in outdoor common areas, though we do not monitor or record private indoor accommodations or personal conversations.

12. Compliance with Laws

Maine State Requirements

  • All services comply with Maine state regulations

  • Pet services comply with Maine animal welfare laws

  • Accommodations comply with Maine lodging and safety regulations

  • Venue operations comply with Maine fire safety and building codes

Federal Compliance

  • We comply with all applicable federal laws including ADA requirements

  • We do not discriminate based on protected characteristics

  • Short-term rentals comply with applicable federal tax reporting requirements

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. For existing bookings, the Terms in effect at the time of booking will apply. Continued use of our website and services after changes are posted constitutes acceptance of the modified Terms.

14. User Content and Reviews

  • You may submit reviews, photos, and other content through our website or third-party platforms

  • You grant us a non-exclusive, royalty-free license to use such content for marketing and promotional purposes

  • You are responsible for ensuring your content does not violate any laws or third-party rights

  • We reserve the right to remove content that violates these Terms or is otherwise inappropriate

15. Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Maine and the United States.

Dispute Resolution Process

  1. Direct communication to resolve issues amicably

  2. Mediation through a mutually agreed mediator if direct communication fails

  3. Binding arbitration in Maine for disputes not resolved through mediation

  4. Court proceedings only for issues not subject to arbitration or as required by law

For disputes arising from third-party platform bookings, platform-specific dispute resolution procedures may also apply.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy and any specific booking agreements, constitute the entire agreement between you and [Business Name] regarding your use of our website and services.
